This privacy statement (the “Privacy Statement”) is issued by Turck Banner SAS, a French société par actions simplifiée, whose registered office is located at 1, rue Irène Joliot Curie, 77700 Bailly Romainvilliers, registered with the trade and companies of Meaux under number 311 361 570.

This Privacy Statement describes the ways in which Turck Banner SAS processes personally identifiable information about you (“Personal Information” or “Information”) including through Turck Banner SAS’ website  https://www.turckbanner.fr and https://www.turckbanner.com/fr (the “Site”).

Turck Banner SAS is the data controller of the Personal Information processed by Turck Banner SAS within the meaning of Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and the free movement of such data (“General Data Protection Regulation” or “GDPR”) and Act n°. 78-17 of January 6, 1978 on data processing, data files, and individual liberties, as amended (Loi n° 78-17 du 6 janvier 1978 relative à l'informatique, aux fichiers et aux libertés modifiée).

This Privacy Statement may be amended or updated from time to time to reflect changes in Turck Banner SAS practices with respect to the processing of Personal Information or changes in applicable law.

III.    INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

Turck Banner SAS may need to transfer your Personal Information for the purposes set out in this Privacy Statement, to third parties as referred to in Section II above, located in other countries that may have different laws and data protection standards to those that apply in the country in which you are located, including to countries outside the European Union (the “EU”) or the European Economic Area (the “EEA”).

To govern such transfers of Personal Information from the EU/EEA to recipients outside the EU/EEA, Turck Banner SAS uses the standard contractual clauses adopted by the European Commission when the Information is transferred to countries that have not been deemed to provide an adequate level of protection for personal data by the European Commission.

IV.    RETENTION PERIODS

Turck Banner SAS will not retain your Personal Information for any longer than the period necessary to fulfil the purposes outlined in this Privacy Statement including the purposes of satisfying any legal or accounting or contractual obligations.

To determine the appropriate retention period for Personal Information, Turck Banner SAS considers its amount, nature, sensitivity, potential risks, processing purposes, possible alternative methods, and legal requirements. When Personal Information is processed as part of legal claims, it will be retained as long as required to complete ongoing legal actions, comply with court orders and/ or fulfil obligations under applicable laws. 
V.    YOUR LEGAL RIGHTS
Subject to applicable law, you may have a number of rights to your Personal Information. If you wish to exercise any of the rights set out below, please contact Turck Banner SAS, as indicated in Section VII.

Turck Banner SAS may need to request specific information from you to confirm your identity and ensure your right to access your Personal Information or to exercise any of your other rights. This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it.

Turck Banner SAS will respond to all legitimate requests without undue delay and in any event within one month of receipt of the request. Occasionally it may take Turck Banner SAS longer than a month, but without exceeding three months, if your request is particularly complex or you have made a number of requests. In this case, Turck Banner SAS will notify you and keep you updated.

A.    RIGHT OF ACCESS 
You may have the right to obtain from Turck Banner SAS confirmation as to whether or not your Personal Information is being processed and where that is the case to obtain a copy of the Personal Information undergoing processing in order to check that Turck Banner SAS is using your Information in accordance with data protection legislation.

B.    RIGHT OF RECTIFICATION
In certain circumstances, you are entitled to have your Information corrected if it is inaccurate or incomplete.

C.    RIGHT TO ERASURE
This right is also known as “the right to be forgotten”. It enables you, subject to applicable law, to ask Turck Banner SAS to delete or remove your Personal Information (a) where there is no good reason for Turck Banner SAS continuing to process it or (b) where you have withdrawn your consent on which the processing was based.

D.    RIGHT OF RESTRICTION OF PROCESSING
In certain circumstances, you are entitled to ask Turck Banner SAS to suspend the processing of your Personal Information in the following cases: (a) the accuracy of the Personal Information is being contested and you request it to be restricted while Turck Banner SAS verifies its accuracy; (b) when it has been determined that the processing of your Personal Information is unlawful and you oppose the erasure of your Personal Information, requesting instead the restriction of its use; (c) when Turck Banner SAS no longer requires the Personal Information for the purpose of processing, but you need it to be kept for the establishment, exercise or defence of a legal claim; (d) when you have objected to processing pursuant to paragraph G below, pending the verification whether the legitimate grounds of Turck Banner SAS override your interests, rights and freedoms.

E.    RIGHT TO INFORMATION PORTABILITY 
In certain circumstances, you are entitled to have the Personal Information you have provided to Turck Banner SAS: (a) sent to you in a structured, commonly used and machine-readable format; (b) sent directly by Turck Banner SAS to another data controller, provided that it is technically feasible.

F.    RIGHT TO WITHDRAW CONSENT
Where Turck Banner SAS is relying on your consent to process your Information, you have the right to withdraw your consent at any time. The withdrawal of consent will not affect the lawfulness of Turck Banner SAS processing of your Information before withdrawal.

G.    RIGHT TO OBJECT TO PROCESSING
In certain circumstances, you may have the right to object to processing of your Personal Information where Turck Banner SAS is relying on a legitimate interest or that of a third party and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms.
